Welcome to Flickbasket. These Terms & Conditions govern your access to and use of the Flickbasket multi-vendor marketplace website, mobile applications, and related services (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms & Conditions.

1. About Flickbasket

Flickbasket is an online marketplace operated by Flickbasket that provides a platform for independent third-party sellers (“Vendors”) to list and sell their products to customers (“Buyers”).

Flickbasket is not the seller, supplier, manufacturer, or distributor of products listed by Vendors and is not a party to the transaction between a Buyer and a Vendor. Flickbasket's role is limited to providing and operating the marketplace Platform.

2. Eligibility

You must be at least 18 years of age and capable of entering into a legally binding contract to use the Platform. By using Flickbasket, you represent that you meet these requirements.

3. Account Registration

To place orders or sell products on the Platform, you may need to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted through your account.

If you suspect unauthorized access to your account, you should take appropriate steps to secure your account and contact the relevant party where necessary.

4. Orders & Payments

When you place an order through the Platform, you are entering into a transaction directly with the applicable Vendor.

Flickbasket does not sell the products listed by Vendors and does not process, receive, or control payments made between Buyers and Vendors. Payment processing, where applicable, is handled through the payment methods or payment service providers made available by the Vendor.

Product prices, availability, delivery timelines, taxes, payment terms, cancellation policies, and other transaction terms are determined by the applicable Vendor and may be displayed on the Platform.

The Vendor is responsible for accepting, fulfilling, cancelling, and providing refunds for orders in accordance with its policies and applicable law.

5. Vendor Responsibilities

Vendors are solely responsible for:

• The accuracy and completeness of their product listings

• Product quality, safety, and authenticity

• Pricing and availability

• Order acceptance and fulfilment

• Packaging and delivery, where applicable

• Cancellations, returns, replacements, and refunds

• Compliance with all applicable laws and regulations

Flickbasket does not guarantee the quality, safety, authenticity, legality, availability, or suitability of products offered by Vendors.

6. Prohibited Use

You agree not to misuse the Platform, including by:

• Attempting unauthorized access to the Platform or another user's account

• Posting or transmitting unlawful, fraudulent, or misleading content

• Interfering with or disrupting Platform operations

• Using the Platform for fraudulent or unlawful purposes

• Violating the rights of Flickbasket, Vendors, or other users

7. Intellectual Property

All Platform content, branding, logos, designs, software, and other materials owned or licensed by Flickbasket are protected by applicable intellectual property laws.

You may not copy, reproduce, modify, distribute, or use Flickbasket's intellectual property without prior written permission, except as permitted by applicable law.

Product images, descriptions, trademarks, and other content provided by Vendors remain the responsibility of the respective Vendor and may be subject to the Vendor's or third-party intellectual property rights.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Flickbasket shall not be liable for the acts, omissions, products, services, payments, deliveries, cancellations, returns, refunds, or other obligations of any Vendor.

Flickbasket shall also not be liable for indirect, incidental, special, or consequential damages arising from your use of the Platform or from transactions between Buyers and Vendors.

To the fullest extent permitted by law, Flickbasket's total liability arising from your use of the Platform shall not exceed the amount, if any, paid by you directly to Flickbasket for the relevant Platform service giving rise to the claim.

9. Changes to These Terms

We may update these Terms & Conditions from time to time. Any changes will become effective when posted on the Platform unless otherwise stated.

Your continued use of the Platform after the updated Terms & Conditions are posted constitutes your acceptance of the revised terms.
